What proof is needed for dowry articles in Pakistan?

Proof of dowry articles in Pakistan requires more than assuming that everything on a list must have been given because dowry is customary. In Farrukh Altaf v. Mst. Sadia Anam, the Lahore High Court explains that credible evidence must connect identifiable articles to delivery and the relief sought. Receipts are not compulsory, and oral testimony can be sufficient.

The practical lesson is to organise the evidence around separate events: acquisition, handover, possession and demands for return. The drafting suggestions below translate the decisions into preparation steps; they are not additional legal conditions imposed by the courts.

Lahore High Court · Approved for reporting

Dowry delivery must be established; custom and purchase alone are insufficient

Farrukh Altaf v. Mst. Sadia Anam etc., W.P. No. 930/2023, 2026 LHC 8119.

Court and judge

Lahore High Court, Rawalpindi Bench; Justice Anwaar Hussain

Dates

Heard and announced 8 October 2026; finalised 24 October 2026

Issue

Disputed inventory, delivery and evidence through a special attorney

Result

Appellate dowry decree set aside; trial dismissal restored

The holding in one sentence

Relaxed family-court evidence rules permit credible oral proof, but do not allow custom, an inventory or purchase receipts to substitute for a reasoned finding that the particular articles were delivered.

The spouses lived in the United States and had not intended to establish a matrimonial home in Pakistan. After their foreign divorce, the wife claimed household articles said to have been delivered in Pakistan. Her mother testified as special attorney, but material uncertainty about delivery remained. The High Court found that the appellate court had not adequately confronted those weaknesses when reversing the trial court.

01

Identify the articles and the evidence

An inventory should permit meaningful examination of existence, delivery and value. Its preparation date and source also matter; a bare total is usually inadequate.

02

Separate purchase from handover

Receipts may support acquisition without proving delivery to the husband or his family. For bulky goods, the transport, recipient and handover circumstances can provide corroboration.

03

Respect ordinary family arrangements

Neither purchase receipts nor formal delivery acknowledgments are indispensable. The Court’s guidelines are flexible tools for evaluating credibility, not a commercial documentation standard.

04

Test each witness’s knowledge

An attorney may prove events personally witnessed or undertaken. A power of attorney does not give the witness knowledge of every fact alleged by the claimant.

05

Assess proven items and value rationally

Courts should distinguish established articles from unproved items rather than mechanically accept or reject a whole list. Compensation needs a reasoned valuation, considering age, condition and use where appropriate.

Authority and limits

Approved for reporting. Its legal principles govern subordinate courts within the Lahore High Court’s jurisdiction, subject to controlling superior authority; elsewhere it may be persuasive. Overseas residence, receipts in relatives’ names, delay and attorney representation were not independent grounds for rejection. The Court did not decide limitation or the preclusive effect of the foreign divorce decree.

Drafting impact · PK-Legal practice suggestions

Build an item-by-item record

For each item record its description, approximate acquisition date, source, payer, available proof and present whereabouts. Identify estimates as estimates.

Plead delivery separately

Explain who arranged transport, the destination, recipient and approximate handover date. Name witnesses with direct knowledge; explain gaps honestly.

Prepare the witness sequence

Match each disputed event with a competent witness. Do not assume that appointing an attorney removes the need for evidence from the person who knows the facts.

Explain value and retention

Support alternative value with an intelligible basis. Record demands for return, responses and the explanation for alleged continued possession.

Answer the inventory specifically

A defence should identify whether acquisition, delivery, retention or valuation is disputed for each material item, instead of relying only on a general denial.

Read the official LHC judgment, particularly paragraphs 5–8 and 10–15.

Sindh High Court · Sukkur Bench

Grandfather maintenance: distinguish present capacity from past liability

Allah Rakha alias Irshad v. Province of Sindh and another, C.P. No. S-155/2025; 29 October 2026. Justice Adnan Iqbal Chaudhry.

Holding

After the father’s death, the grandfather’s admitted bakery income and failure to prove incapacity supported continued monthly maintenance of Rs.7,000.

The SHC removed Rs.100,000 in past maintenance. The mother’s earlier undertaking to bear expenses was relevant to her means during that period, but did not permanently waive the child’s future support. The remaining decree stayed intact.

Limit

This fact-specific outcome does not make every grandfather automatically liable or set a standard maintenance rate.

Drafting impact · PK-Legal practice suggestions

Separate the periods

Plead the father’s death, relevant family means and distinct past and prospective claims. Address previous undertakings.

Support capacity with evidence

Collect available business, income and dependant records; explain changed circumstances.

Read the official SHC order.

A QR-verifiable CFMS copy did not satisfy the certified-copy rule

Sadam Hussain v. Mst. Shahneela and others, C.P. No. S-185/2026; 26 October 2026. Justice Adnan Iqbal Chaudhry.

Holding

The CFMS copy did not meet Rule 22(3)’s certified-copy requirement for the Guardian Appeal. QR authentication alone was insufficient.

Because the appellate court had not objected at the outset, the SHC restored the appeal and allowed ten days to apply for condonation of the delay in producing the certified copy. Sufficient cause remained necessary under Rule 22(1); neither condonation nor custody was decided in the petitioner’s favour.

Limit

Apply this procedural ruling with the rules governing the particular forum. It does not invalidate all digital court documents.

Drafting impact · PK-Legal practice suggestions

Preserve the chronology

Obtain the certified copy and record application, preparation and collection dates.

Explain any delay

Support the limitation calculation and any reliance on initial court acceptance with the record.

Read the official SHC order.

A section 12(2) application cannot simply reopen a contested family decree

Muhammad Afzal v. Maria Tariq and others, C.P. No. 1111/2026; 26 October 2026. Justice Zulfiqar Ali Sangi.

Official summary

The petitioner had contested the trial. His section 12(2) application identified no qualifying fraud or misrepresentation; blaming former counsel for not explaining limitation did not, by itself, justify condonation. The constitutional petition was dismissed.

Verification and scope

The official index records A.F.R. “No”. The case details and holding were cross-checked against the SHC index and published summary; the full PDF could not be retrieved. No broader conclusion about section 12(2)’s availability in every family case is drawn.

Drafting impact · PK-Legal practice suggestions

Particularise the alleged defect

Identify the act, person, date, effect and supporting record. Do not relabel disagreement with the merits as fraud.

Account for appellate delay

Prepare a supported chronology; a general complaint about former counsel is insufficient by itself.

Consult the official SHC case index.

Preparation before filing

Organise the record before drafting the next application

01

Separate evidence from inference

Label what a witness personally knows, what documents establish and what remains an inference. Never fill missing facts with assumptions.

02

Keep a dated procedural file

Retain the plaint, written statement, evidence, orders, copy applications and appeal papers in chronological order.

03

Choose the correct relief

Distinguish return of property, alternative value, past and future support, and procedural relief. Check the applicable forum and rules before filing.

Frequently asked questions

Proof of dowry articles in Pakistan: common evidence questions

Are purchase receipts compulsory to prove dowry articles in Pakistan?

No. Farrukh Altaf, 2026 LHC 8119, recognises that credible oral evidence can establish a dowry claim without receipts. The court must still assess which articles were given, whether they were delivered and the basis of the relief claimed.

Does a dowry list prove that every listed item was delivered?

Not automatically. The court examines who prepared the list, when it was prepared, its source and the evidence connecting the articles to delivery. A detailed inventory assists identification but does not replace credible proof.

What evidence can help establish delivery of dowry articles?

A consistent account from people who witnessed or arranged delivery can help. Explain the transport, destination, recipient and circumstances of handover. Available photographs, messages or records can support that account; the judgment does not impose a compulsory transport receipt or signed delivery form.

Can a receipt in a relative’s name support a dowry claim?

Yes. A receipt need not invariably bear the bride’s or her parents’ name. Its date, purchaser and contents should be connected to the articles claimed. A different name alone neither defeats nor proves the claim.

Can a mother or special attorney give evidence about dowry?

An attorney can testify about matters personally witnessed or undertaken. Authority to represent the claimant does not establish events outside the attorney’s knowledge. The reliability and scope of the actual testimony remain important.

How should the alternative value of dowry articles be assessed?

The judgment requires a rational basis for compensation instead of return. The nature, age, condition and use of the articles may matter where appropriate. It does not prescribe a universal depreciation percentage or require mechanical rejection of the entire inventory.

Does living abroad or delaying a claim automatically defeat recovery?

No. Farrukh Altaf treats overseas residence and the passage of time as circumstances to assess with the evidence, not automatic grounds for rejection. The Court expressly did not decide whether the foreign divorce decree barred the claim or whether the claim was time-barred.

What should I organise before asking a lawyer to review a dowry claim?

Prepare an item-by-item list, identify witnesses with direct knowledge, gather available purchase and delivery material, and record demands for return. Mark estimates honestly and explain missing records. This is a preparation checklist, not a statutory requirement to produce every document.
