A property transfer soon after marriage, with no sign of payment, can discharge dower

Tanveer Ahmed v. District Judge, Rahim Yar Khan, etc. Lahore High Court W.P. No. 7940 of 2019 2025 LHC 6632 Decided Justice Anwaar Hussain (Bahawalpur Bench)

Judgment at a glance

Legal issue
Was four marlas of land, mutated to the wife as an 'oral sale' from her father-in-law within a month of the marriage, a sale to her or payment of her dower?
Decision
Payment of dower. The husband bought the land from his father and had it mutated directly to his wife within a month of the marriage, with no consideration from her; she admitted in cross-examination that her husband had transferred the plot to her as dower, an admission the appellate court could not dismiss as a 'slip of the tongue'; she said she had no means to buy property; and she did not call her brother, said to have been present, which raised an adverse inference under Article 129(g). Nothing in law prevents a father-in-law transferring property directly to his daughter-in-law in discharge of his son's dower obligation. Sympathy for a wife cannot override clear evidence; the appellate judgment was set aside and the trial court's decree restored.
Key principle
A transfer of property to the wife soon after marriage, without any consideration from her, may be found to be payment of dower even if recorded as a sale and made directly by the husband's father; an admission in cross-examination cannot be brushed aside as a slip of the tongue without reason.
Outcome
Allowed
Relevant law
Qanun-e-Shahadat Order 1984, Art. 129; Constitution of Pakistan 1973, Art. 199
Why it matters
  • Husbands: keep evidence that a transfer was made in lieu of dower.
  • Wives: be ready to show any 'sale' to you was genuinely paid for.
  • Courts decide dower on the evidence, not on presumptions in either party's favour.
