A wife’s withdrawal of dower and maintenance claims can be recalled if she lacked independent advice
Asif Iqbal v. Additional District Judge etc. Lahore High Court W.P. No. 9844 of 2024 2025 LHC 7834 Decided Justice Anwaar Hussain (Bahawalpur Bench)
Judgment at a glance
- Legal issue
- Can a wife who withdrew her suit for dower, dowry and maintenance in court, without her own lawyer or independent advice, have that statement recalled despite the sanctity attached to statements made in judicial proceedings?
- Decision
- Yes. Statements recorded in court are ordinarily treated as conclusive, but the rule is not absolute: the court must examine whether the act was truly voluntary and free from undue influence or fraud. Here she came to court with only her husband, on a day the case was not fixed, represented by a lawyer from the same chamber as her husband's counsel; the statement was recorded in English although she is a matric-pass housewife; and she went to her own lawyer the same day to challenge it. The Family Court, acting on the appellate court's remand, rightly allowed the statement to be recalled, and the husband's petition was dismissed. The Court laid down safeguards for statements by vulnerable litigants such as women in family cases.
- Key principle
- When a vulnerable litigant, such as a woman in a family case, makes a statement in court, the presiding officer must record it in a language she understands, read it over and question her on its effect, ensure that an illiterate woman is accompanied by a literate relative with no adverse interest, and confirm that she acts voluntarily with independent advice from counsel of her choice.
- Outcome
- Dismissed
- Relevant law
- Constitution of Pakistan 1973, Art. 199
- Why it matters
- A withdrawal or compromise statement made without understanding or independent advice can be challenged, and acting quickly helps.
- Courts should question the woman directly about the statement's effect before recording it.
- Husbands relying on such a statement should expect it to be scrutinised.
