A dowry claim joined to a maintenance and dower suit stays in the court where the wife lives
Muhammad Ahmad Tariq v. Judge Family Court, D.G. Khan, etc. Lahore High Court W.P. No. 836 of 2026 2026 LHC 1286 Decided Justice Muzamil Akhtar Shabir (Multan Bench)
Judgment at a glance
- Legal issue
- Where a wife sues in the place she ordinarily resides for maintenance, dower and dowry articles, without asking for dissolution, can the dowry claim be struck out because a dowry suit alone would belong where the cause of action arose or the parties last lived together?
- Decision
- No. Rule 6 allows a suit for dissolution or dower to be filed where the wife ordinarily resides, and the proviso to section 7(2) of the Family Courts Act, which lets a dissolution plaint include dowry, maintenance, dower and other claims, is permissive: it does not stop a wife from joining those claims in a suit that does not seek dissolution. Having filed for dower where she lives, she could join maintenance and dowry there; and a plaint cannot be rejected piecemeal. The Family Court rightly refused to delete the dowry claim and the husband's petition was dismissed.
- Key principle
- Family claims may be joined in one composite suit even without a prayer for dissolution; a suit that includes dower may be filed where the wife ordinarily resides (r.6), and claims joined to it, including dowry, cannot be struck out piecemeal for want of territorial jurisdiction.
- Outcome
- Dismissed
- Relevant law
- Family Courts Act 1964, s.7; Family Courts Rules 1965, r.6; Constitution of Pakistan 1973, Art. 199
- Why it matters
- A wife can file dower, maintenance and dowry claims together where she ordinarily lives, even if she is not seeking dissolution.
- A husband cannot split a composite family suit by objecting to the place of filing for one claim only.
- A dowry claim filed on its own still belongs where the cause of action arose or the parties lived together.
