Divorce in Pakistan

A divorce in Pakistan is not complete when the words are said. Under Section 7 of the Muslim Family Laws Ordinance, 1961, written notice must go to the Union Council Chairman with a copy to the wife; an Arbitration Council tries reconciliation, and the talaq takes effect 90 days after the Chairman receives the notice, unless it is revoked. A wife can end the marriage through Khulla or dissolution in the Family Court.

A talaq in Pakistan does not take effect on the day it is pronounced. Under Section 7 of the Muslim Family Laws Ordinance, 1961, the husband must give written notice to the Chairman of the Union Council and a copy to the wife. The Chairman forms an Arbitration Council to attempt reconciliation, and the talaq becomes effective only when 90 days have passed from the day the Chairman received the notice, unless it is revoked in that time. If the wife is pregnant, it does not take effect until the pregnancy ends, if that is later.

After a Khulla decree or other court dissolution, the decree is sent to the Chairman and the same procedure applies under Section 8.

This calculator only adds the statutory periods to the date you enter. The dates that count in your case depend on when the notice was actually delivered, on any revocation, and on the Union Council's records. It is general information, not legal advice.

The talaq process, stage by stage

Under Section 7 of the Muslim Family Laws Ordinance, 1961. Choose the stage you are at to see what happens next.

  1. Talaq and written notice

    Day 0 · MFLO 1961, s.7(1)

After pronouncing talaq, the husband gives written notice to the Chairman of the Union Council where the wife lives, and a copy to the wife.

  2. Arbitration Council

    Within 30 days · MFLO 1961, s.7(4)

The Chairman constitutes an Arbitration Council with a representative of each spouse to try to bring about reconciliation.

  3. Reconciliation period

    Days 1–90 · MFLO 1961, s.7(3)

The talaq can be revoked during this period. If the wife is pregnant, it does not take effect until the pregnancy ends, if that is later.

  4. Talaq takes effect

    90 days after notice · MFLO 1961, s.7(3), s.7(5)

Unless revoked, the talaq becomes effective when 90 days have passed from the day the Chairman received the notice.

  5. Union Council certificate

    After day 90

The Union Council issues a certificate confirming the divorce has taken effect.

  6. Computerised divorce certificate and CNIC

    After the UC certificate

The Union Council issues the computerised Divorce Registration Certificate from NADRA's system, needed for remarriage and overseas use. Marital status on the CNIC is then updated at NADRA.

Section 7, subsection by subsection

  1. s.7(1) Written notice. A husband who wishes to divorce his wife must, as soon as may be after pronouncing talaq in any form, give the Union Council Chairman written notice that he has done so, and give a copy to the wife.
  2. s.7(2) Penalty. Not giving the notice is an offence, punishable with simple imprisonment of up to one year, a fine of up to Rs 5,000, or both.
  3. s.7(3) The 90 days. Unless revoked earlier, expressly or otherwise, the talaq does not take effect until 90 days have passed from the day the notice is delivered to the Chairman.
  4. s.7(4) Arbitration Council. Within 30 days of receiving the notice, the Chairman forms an Arbitration Council to try to reconcile the spouses.
  5. s.7(5) Pregnancy. If the wife is pregnant when talaq is pronounced, it does not take effect until the 90 days or the pregnancy ends, whichever is later.
  6. s.7(6) Remarrying each other. After a talaq becomes effective, the same couple may remarry without an intervening marriage to someone else, unless this is the third time a talaq has become effective between them.

Section 8 applies the same procedure, with necessary changes, to a divorce by the wife under a delegated right (column 18 of the Nikahnama) and to other dissolutions, including Khulla.

Common questions

What if the husband never sends the notice?

He commits an offence under section 7(2). Whether the talaq itself is still valid is argued both ways; courts look at the facts, and a wife can herself bring an already pronounced talaq to the Chairman's notice (Lahore High Court, 2026 LHC 6754).

Can a talaq be taken back?

Yes, within the 90 days, expressly or by conduct (s.7(3)). The Supreme Court confirmed in November 2025 that this applies to every form of talaq, including triple talaq. Tell the Union Council in writing so the record is clear.

Does a talaq sent by SMS or WhatsApp count?

A message alone does not complete the legal process; the written notice to the Union Council is still required. See divorce by SMS or WhatsApp.

When do the 90 days start?

From the day the Chairman receives the notice, not the date written on the talaq deed. Use the calculator above.

Can we remarry each other after the divorce?

Yes, with a fresh Nikah, unless this was the third talaq to become effective between you (s.7(6)).
